The protection of your personal data is a priority for Estação Malabarista - Casas da Estação. Below, we describe who we are, the purposes for which we may use your data, how we process it, with whom we share it, how long we retain it, as well as how you can contact us and exercise your rights.

Who are we?

Your data will be processed by Estação Malabarista Lda, with VAT number 513818472 (hereinafter referred to as Estação Malabarista Lda).

Estação Malabarista Lda is responsible for the processing of your personal data in accordance with the General Data Protection Regulation (hereinafter referred to as GDPR).

Why do we process your information?

Your personal data may be collected and processed by Estação Malabarista Lda for the following purposes:

a) To comply with legal obligations to which Estação Malabarista Lda is subject, including communications to the Immigration and Borders Service and invoicing.

b) To execute the Temporary Accommodation Contract for Tourists or the Local Accommodation Management Contract entered into with Estação Malabarista Lda, such as payment transactions, check-in and check-out management, guest management, deposit blocking, provision of complementary services such as cleaning, transfers, and breakfast or grocery services, management of contractual obligations, or for pre-contractual procedures.

c) For contact purposes via email, mobile communications, and digital platforms, within the marketing strategies of Estação Malabarista Lda, commercial and contractual information and communications, as well as for information requests.

d) For the protection of property owned or under the custody of Estação Malabarista Lda, as well as for statistical analysis purposes.

Failure to provide personal data for the purposes set out in points a) and b) will result in Estação Malabarista Lda’s non-compliance with the legal obligations imposed and consequently the possibility of terminating the Temporary Accommodation Contract for Tourists or the Local Accommodation Management Contract entered into, without the right to any compensation, as well as the provision of deficient services by Estação Malabarista Lda, which will not be attributable to it.

What type of personal data do we collect?

In the scope of its activities, Estação Malabarista Lda will collect and process the personal data necessary to provide the contracted services, information requests, or pre-contractual management, including identification data, contact information, banking or payment card details.

Why do we process your information?

The processing of your personal data will be carried out based on the execution of the Temporary Accommodation Contract for Tourists, the Local Accommodation Management Contract, and the compliance with legal obligations imposed on Estação Malabarista Lda, including legislation regarding the Entry, Stay, and Exit of Foreigners in the National Territory and tax legislation (Article 6, paragraph 1, letters b) and c) of the GDPR).

Additionally, the personal data collected for the purposes set out in point c) of the previous section is based on the consent you have provided to Estação Malabarista Lda for its processing (Article 6, paragraph 1, letter a) of the GDPR).

For the purposes set out in point d) of the previous section, Estação Malabarista Lda will process personal data based on the legitimate interest pursued by you (Article 6, paragraph 1, letter f) of the GDPR).

How long do we retain your information?

Unless required by legal, regulatory provisions, or judicial determination, the personal data collected will be retained only for the minimum period necessary for the purposes for which they were collected or further processed.

Who may we share your personal data with?

Estação Malabarista Lda may need to share some of your personal data with other recipients. These recipients include:

a) Organizations and/or companies affiliated with Estação Malabarista Lda, provided they comply with an equivalent policy regarding personal data protection.

b) Public entities to which Estação Malabarista Lda is legally required to provide information, such as the Immigration and Borders Service and the DGCI – Directorate General of Taxes.

c) Subcontractors providing certain services related to your personal data under a subcontract, with the sole purpose of providing technical assistance to Estação Malabarista Lda. These include, among others, web hosting providers, email marketing service providers, cleaning service companies, law firms, accounting firms, and insurance companies.

d) Competent authorities to which Estação Malabarista Lda is legally required to disclose information in the course of judicial proceedings or to detect technical and/or security problems, such as judicial entities or competent regulatory authorities.

Are my data transferred to countries outside the European Union?

Your personal data collected by Estação Malabarista Lda will not be transferred to any entity established outside the European Union.

Exceptionally and under certain conditions, Estação Malabarista Lda may transfer your personal data to countries outside the European Union, in accordance with the applicable legislation, specifically for purposes such as data hosting, storage, technical subcontracting of processing, data backup, and recovery, and service development.

Estação Malabarista Lda ensures that it will not transfer your personal data to countries that do not provide an adequate level of protection, in accordance with the provisions of the GDPR.

What are my rights?

At any time, under the provisions of the GDPR, you may request access to your personal data, as well as its rectification or deletion, restriction of processing, right to object, and right to data portability.

If the requests are manifestly unfounded or excessive, particularly due to their repetitive nature, Estação Malabarista Lda may charge a reasonable fee considering the administrative costs of providing the information or communications, or taking the requested measures, or refuse to comply with the request.

Regarding personal data whose processing by Estação Malabarista Lda is based on consent, you have the right to withdraw your consent, without affecting the lawfulness of the processing based on the consent previously given, nor the further processing of the same data based on another legal basis, such as contract performance or legal obligation to which Estação Malabarista Lda is subject.

You also have the right to file a complaint with the National Data Protection Commission.

Security and Confidentiality

We are committed to keeping your data secure by applying appropriate technical and organizational measures to ensure a level of security appropriate to the risk of keeping your personal data on file. However, the transmission of information over the Internet is not completely secure, and we cannot guarantee the absolute security of information transmitted through our website.

We also respect the confidentiality of your information. Therefore, we do not sell, distribute, or in any other way commercially make your information available to third parties.
