TERMS AND CONDITIONS
Booking Conditions
Bookings are subject to accommodation availability and payment confirmation.
To confirm the booking, the guest must complete the corresponding payment.
The rates for bookings are the ones advertised at any given moment on the respective accommodation page. The booking will be subject to cancellation if the payment cannot be processed, so it is important for the guest to ensure that their credit card is valid and has sufficient funds.
In case of authorization failure, the guest will be notified by email or SMS and will have 12 hours to attempt to use an alternative payment method. All prices include VAT at the legal rate in force.
Payment Methods
Bookings can be paid via bank transfer, Mbway, or American Express, Visa, or MasterCard credit card.
Pre-check-in
Upon booking completion, the person making the booking will receive an email and/or SMS from Casas da Estação with the booking confirmation and important information about the accommodation.
Guests will be asked to provide some essential details for the preparation of their stay, including the estimated arrival time and the total number of people staying — so we can ensure the correct amount of bed linen and towels are provided. Guests should indicate the exact number of people. The number of guests specified in the reservation must not exceed the number of people staying in the accommodation. If the number of guests exceeds the limit, ESTAÇÃO MALABARISTA LDA. reserves the right to require the guests to leave the accommodation with no compensation or refund of the amounts paid.
Cancellation Conditions
After confirmation of the booking, the following fees will apply in case of cancellation:
a) The guest will pay 50% of the total booking value if cancelled up to 30 days before check-in.
b) The guest will pay 100% of the total booking value if cancelled less than 30 days before the check-in date.
In the event of overbooking (i.e., simultaneous bookings in the same accommodation), the guest expressly acknowledges and agrees that ESTAÇÃO MALABARISTA LDA. may relocate the booking to an accommodation of the same category (in any case, ensuring that the quality of the provided accommodation is not inferior to the one initially booked by the guest), at no additional cost to the guest and without entitlement to compensation from ESTAÇÃO MALABARISTA LDA.
Stay Conditions
The person making the reservation must be at least 18 years old and must remain in the booked accommodation throughout the stay. Guests under 18 years old can only be accommodated if accompanied by an adult who is the reservation holder.
The reservation holder must provide a valid address, telephone contact, and email address.
Pets (of any breed, size, or age) are not allowed in the accommodations of ESTAÇÃO MALABARISTA LDA.
ESTAÇÃO MALABARISTA LDA. reserves the right to require guests to leave the accommodation without compensation or refund of fees paid if any pet is found inside.
Smoking is not allowed inside the accommodation.
Guests must notify ESTAÇÃO MALABARISTA LDA. of any damage to the accommodation, contents, equipment, or accessories that occurs during the stay, even if the guest believes the damage is due to regular wear and tear and not their fault. If the guest does not notify ESTAÇÃO MALABARISTA LDA. of such damage, they may be held responsible for it.
Additional Services
ESTAÇÃO MALABARISTA LDA. offers a range of additional services to guests, such as group bookings, meal services, cleaning and laundry services, cribs, and divans.
All additional services are subject to request and availability confirmation.
ESTAÇÃO MALABARISTA LDA. is not responsible for any services provided by external suppliers.
Check-in and Check-out
Unless otherwise agreed, accommodation check-in will take place between 16:00 and 20:00.
In case of late check-in (after 20:00), a fixed fee of €30 may be charged, payable upon check-in.
Check-out must be completed by 11:00 AM, and all guests must leave the accommodation by the specified time. If a representative of ESTAÇÃO MALABARISTA LDA. is not available at the time of check-out, the guest may leave the keys on the main table inside the accommodation and close the door. Guests MUST NOT leave the keys in the door lock.
If the guest refuses to leave, ESTAÇÃO MALABARISTA LDA. reserves the right to enter the accommodation, remove the guest's belongings, change the locks, and take any other necessary measures (the guest will be responsible for any costs incurred from such actions).
Any changes to the check-in and check-out times and dates must be confirmed by ESTAÇÃO MALABARISTA LDA. In case of delays without prior notice and without ESTAÇÃO MALABARISTA LDA.'s confirmation, the guest will be charged an amount equivalent to the rate of one night.
At check-in, ESTAÇÃO MALABARISTA LDA. provides only ONE set of keys. Guests should be careful not to lose them or leave them inside the apartment. Guests must return all keys at check-out.
Additional fees may apply for lost keys or lockouts. If a locksmith service is required, the guest will be responsible for the total cost charged by the service provider.
ESTAÇÃO MALABARISTA LDA. is not responsible for any items left inside the apartment after the guest's departure. Any items found in the apartment may be returned upon request. The guest is fully responsible for any expenses related to the process of returning their belongings.
Cleaning, Bedding, and Towels
The accommodation will be cleaned before the guest's arrival. The basic service from ESTAÇÃO MALABARISTA LDA. includes one set of towels, bed linens, and some hygiene items for each reservation.
Additional cleaning services and products, including changing sheets and towels, are available for an additional fee.
Guests should keep the accommodation as organized and clean as possible, returning it in the best condition for the next guest.
Guests should not leave trash inside the accommodation, near the door, or outside the building (where applicable) and should use the designated street trash bins.
Equipment, Furniture, and Items in the Accommodation
If any equipment is not working, or if guests are unsure how to use any item in the accommodation, they should contact the host responsible for ESTAÇÃO MALABARISTA LDA.
No alterations are allowed to the accommodation or its contents.
All items found in the accommodation belong to the owner and should not be moved or removed from the property during the stay.
Maintenance and Special Requests
Any issues inside the accommodation (e.g., electrical problems, equipment malfunction, water leaks) should be immediately reported to ESTAÇÃO MALABARISTA LDA. by email or phone.
Depending on the issue, resolution may take up to 72 hours, or longer, if it depends on third-party services.
While respecting the guests' privacy, ESTAÇÃO MALABARISTA LDA. reserves the right to access the accommodation at any time if necessary for inspections, repairs, or emergencies.
Extra beds and cribs for babies can be requested in advance but are subject to availability.
Noise, Illegal Activity, Security
According to the law, the quiet hours are between 22:00 and 08:00, so guests must maintain silence.
Guests should not disturb neighbors, particularly by opening or closing the accommodation door or the building door (where applicable).
Bookings for illegal or immoral activities are not accepted.
The guest whose name is on the booking confirmation email will be responsible for the behavior of the entire group and agrees to avoid any illegal activities.
Guests are not allowed to invade the privacy of the owner or publish anything that could allow third parties to identify the address of the property or the owner's identity (even if such information is already public).
Guests are primarily responsible for their own safety during their stay at ESTAÇÃO MALABARISTA LDA. Guests must listen to any instructions or explanations provided by ESTAÇÃO MALABARISTA LDA. during check-in.
If a guest becomes aware of something during their stay that they believe poses a health or safety risk, they must immediately inform ESTAÇÃO MALABARISTA LDA. Upon leaving the accommodation, guests should ensure that gas appliances are turned off, windows are closed, air conditioning, heating, and lights are turned off.
Liability
ESTAÇÃO MALABARISTA LDA.'s service is legally limited to its accommodations and the relationship with guests during their stay. ESTAÇÃO MALABARISTA LDA. will not be responsible for any incidents outside the accommodation's limits, such as building cleaning and maintenance, external noise, construction, neighbors, or any other issues not directly related to the accommodation itself.
The photos and descriptions of the accommodations are provided by ESTAÇÃO MALABARISTA LDA. Minor changes may occur in the accommodation compared to the website photos, without affecting its general condition or amenities.
ESTAÇÃO MALABARISTA LDA. will not compensate guests, refund fees, or transfer guests to other accommodations based on the appearance of the accommodation or surrounding area. It is the guests' responsibility to ensure, before booking, that the area or neighborhood they choose is to their liking.
ESTAÇÃO MALABARISTA LDA. is not responsible for any damages caused, directly or indirectly, that may occur during the guest's stay, such as personal injury, theft, criminal behavior, losses due to fire or misconduct, etc. This also applies to any deficiencies in the supply of gas, electricity, water, telephone, or internet.
All thefts, robberies, or any criminal behavior should be immediately reported by the guest to ESTAÇÃO MALABARISTA LDA., as well as to the competent police or judicial authorities.
ESTAÇÃO MALABARISTA LDA. is not responsible for delays, accidents, losses, or changes to schedules or rates related to the services provided by our suppliers. ESTAÇÃO MALABARISTA LDA. is not responsible for errors and/or omissions, false statements by third parties, disputes between a guest and a third party, or the content of external links other than the one used for the reservation.
In the event that guests fail to comply with these terms and conditions, or in case of bad behavior by the guests, ESTAÇÃO MALABARISTA LDA. reserves the right to require them to leave the accommodation without any compensation or refund of fees paid.
Legislation and Force Majeure
This agreement is entered into between the guests and ESTAÇÃO MALABARISTA LDA., which is duly authorized to provide accommodation rentals. This agreement grants the guests permission to occupy the accommodation during the agreed period and under the agreed terms.
Guests are not tenants of the accommodation and do not have exclusive possession of it. In the rare case that a reserved accommodation becomes unavailable due to damage caused by circumstances beyond the control of ESTAÇÃO MALABARISTA LDA., such as water or gas leaks, ESTAÇÃO MALABARISTA LDA. will not be responsible for any inconvenience caused. However, it will take all necessary measures to relocate the guest to an accommodation with similar features.
If guests do not accept the relocation, the total amount (excluding costs related to the days the apartment was used, if applicable) will be refunded. However, neither the owner nor ESTAÇÃO MALABARISTA LDA. will be liable to the guests for any additional amounts related to the cancellation of the reservation. ESTAÇÃO MALABARISTA LDA. will not be responsible for the potential theft of items left in the accommodation.
Changes and Applicable Jurisdiction
ESTAÇÃO MALABARISTA LDA. reserves the right to update its terms and conditions at any time as necessary. It is the responsibility of the parties using the ESTAÇÃO MALABARISTA LDA. service to review these terms and conditions before making a reservation.
By agreeing to use the ESTAÇÃO MALABARISTA LDA. service, the guest accepts any changes and agrees that all parties will comply with them. These terms and conditions do not affect the guests' rights.
These terms and conditions are subject to Portuguese law. Portuguese courts have exclusive jurisdiction in case of legal action related to any accommodation booking with ESTAÇÃO MALABARISTA LDA.
